| REGULAMIN SKLEPU INTERNETOWEGO, PLATFORMY B2B ORAZ USŁUG ELEKTRONICZNYCH | TERMS AND CONDITIONS OF THE ONLINE STORE, B2B PLATFORM AND ELECTRONIC SERVICES |
| I. DEFINICJE | I. DEFINITIONS |
Ilekroć w dalszej części Regulaminu użyto niżej wymienionych zwrotów pisanych wielką literą, należy je rozumieć w podanym niżej znaczeniu, chyba że z kontekstu ich użycia wyraźnie wynika co innego: |
Whenever the following capitalised terms are used in these Terms and Conditions, they shall have the meanings set out below, unless the context in which they are used clearly indicates otherwise: |
1. Konto – indywidualne konto Klienta w ramach platformy sprzedażowej B2B dostępnej pod adresem dambat.abstore.pl, umożliwiające dostęp do jej funkcjonalności, w szczególności do danych Klienta, historii Zamówień oraz indywidualnych warunków handlowych; |
1. Account – an individual Customer account within the B2B sales platform available at dambat.abstore.pl, enabling access to its functionalities, in particular the Customer's data, Order history and individual commercial terms; |
2. Koszyk – funkcjonalność Sklepu umożliwiająca wybór Produktów, określenie ich liczby oraz przejście do formularza Zamówienia; dodanie Produktu do Koszyka nie oznacza jego rezerwacji ani zawarcia Umowy Sprzedaży; |
2. Cart – a Store functionality enabling the selection of Products, specification of their quantity and proceeding to the Order form; adding a Product to the Cart does not constitute its reservation or the conclusion of a Sales Agreement; |
3. Klient – osoba fizyczna, osoba prawna albo jednostka organizacyjna, której ustawa przyznaje zdolność prawną, korzystająca ze Sklepu, w szczególności z Usług Elektronicznych lub zawierająca ze Sprzedawcą Umowę Sprzedaży; |
3. Customer – a natural person, a legal person or an organisational unit granted legal capacity by law, using the Store, in particular the Electronic Services, or entering into a Sales Agreement with the Seller; |
4. Kodeks Cywilny – ustawa z dnia 23 kwietnia 1964 r. Kodeks cywilny (t.j. Dz. U. z 2026 r. poz. 795); |
4. Civil Code – the Act of 23 April 1964 – Civil Code (consolidated text: Journal of Laws of 2026, item 795); |
5. Konsument – Klient będący osobą fizyczną, dokonujący ze Sprzedawcą czynności prawnej niezwiązanej bezpośrednio z jego działalnością gospodarczą lub zawodową, w rozumieniu art. 22¹ Kodeksu Cywilnego; |
5. Consumer – a Customer who is a natural person and enters into a transaction with the Seller which is not directly related to that person's business or professional activity, within the meaning of Article 22¹ of the Civil Code; |
6. Przedsiębiorca na prawach Konsumenta – osoba fizyczna zawierająca ze Sprzedawcą umowę bezpośrednio związaną z jej działalnością gospodarczą, gdy z treści tej umowy wynika, że nie posiada ona dla tej osoby charakteru zawodowego, wynikającego w szczególności z przedmiotu wykonywanej przez nią działalności gospodarczej udostępnionego na podstawie przepisów o Centralnej Ewidencji i Informacji o Działalności Gospodarczej; |
6. Business Customer with consumer rights – a natural person who enters into an agreement with the Seller directly related to that person's business activity where the content of the agreement shows that it is not of a professional nature for that person, arising in particular from the subject matter of the business activity made available under the provisions governing the Central Register and Information on Business Activity; |
7. Ustawa o Prawach Konsumenta – ustawa z dnia 30 maja 2014 r. o prawach konsumenta (t.j. Dz. U. z 2024 r. poz. 1796 ze zm.); |
7. Consumer Rights Act – the Act of 30 May 2014 on Consumer Rights (consolidated text: Journal of Laws of 2024, item 1796, as amended); |
8. Trwały nośnik – materiał lub narzędzie umożliwiające Klientowi lub Sprzedawcy przechowywanie informacji kierowanych osobiście do niego w sposób umożliwiający dostęp do informacji w przyszłości przez czas odpowiedni do celów, jakim te informacje służą, i pozwalający na odtworzenie przechowywanych informacji w niezmienionej postaci; |
8. Durable medium – any material or instrument enabling the Customer or the Seller to store information addressed personally to that party in a way accessible for future reference for a period adequate for the purposes of the information and allowing the unchanged reproduction of the stored information; |
9. Polityka Prywatności – dokument „Polityka prywatności” dostępny pod adresem: https://dambat.abstore.pl/polityka-prywatnosci,55,pl.html; |
9. Privacy Policy – the document titled ‘Privacy Policy’ available at: https://dambat.abstore.pl/polityka-prywatnosci,55,pl.html; |
10. Regulamin – niniejszy regulamin sklepu internetowego, platformy B2B oraz usług elektronicznych stanowiący również regulamin, o którym mowa w art. 8 ustawy z dnia 18 lipca 2002 r. o świadczeniu usług drogą elektroniczną (t.j. Dz. U. z 2024 r. poz. 1513 ze zm.); |
10. Terms and Conditions – these terms and conditions of the online store, B2B platform and electronic services, also constituting the terms and conditions referred to in Article 8 of the Act of 18 July 2002 on the Provision of Electronic Services (consolidated text: Journal of Laws of 2024, item 1513, as amended); |
11. Sklep lub Sklep Internetowy – serwis internetowy dostępny pod adresem www.dambat.pl oraz powiązana z nim platforma sprzedażowa B2B dostępna pod adresem dambat.abstore.pl, za pośrednictwem których Sprzedawca świadczy Usługi Elektroniczne i umożliwia zawieranie Umów Sprzedaży; użyte w Regulaminie pojęcie „Sklep” oznacza odpowiednio każdą z tych platform; |
11. Store or Online Store – the website available at www.dambat.pl and the related B2B sales platform available at dambat.abstore.pl, through which the Seller provides Electronic Services and enables Sales Agreements to be concluded; references to the ‘Store’ in these Terms and Conditions mean either platform, as applicable; |
12. Sprzedawca – DAMBAT JASTRZĘBSKI SPÓŁKA KOMANDYTOWO-AKCYJNA z siedzibą w Adamowie, adres: Adamów 50, 05-825 Grodzisk Mazowiecki, wpisana do rejestru przedsiębiorców Krajowego Rejestru Sądowego pod numerem KRS: 0001025584, NIP: 5291844129, REGON: 523804469, adres poczty elektronicznej: biuro@dambat.pl, będąca jednocześnie usługodawcą w zakresie Usług Elektronicznych; |
12. Seller – DAMBAT JASTRZĘBSKI SPÓŁKA KOMANDYTOWO-AKCYJNA, with its registered office in Adamów, address: Adamów 50, 05-825 Grodzisk Mazowiecki, entered in the Register of Entrepreneurs of the National Court Register under KRS number 0001025584, Tax Identification Number (NIP): 5291844129, National Business Registry Number (REGON): 523804469, e-mail address: biuro@dambat.pl, which is also the service provider in respect of the Electronic Services; |
13. Siła Wyższa – zdarzenie nadzwyczajne faktyczne lub prawne, którego Sprzedawca i Klient, nawet przy dołożeniu należytej staranności, nie mogli przewidzieć, względnie przewidzieć mogli, lecz zapobieżenie mu nie było możliwe, powodujące lub mogące powodować zakłócenia w korzystaniu z Usług Elektronicznych lub realizacji Umowy Sprzedaży (np. konflikty międzynarodowe, akty terroryzmu lub sabotażu, działania wojenne, rewolucje, rewolty, zamieszki, niepokoje społeczne, lokauty, strajki, klęski żywiołowe); |
13. Force Majeure – an extraordinary factual or legal event which the Seller and the Customer, even when exercising due care, could not have foreseen, or could have foreseen but could not have prevented, causing or capable of causing disruption to the use of the Electronic Services or the performance of a Sales Agreement (e.g. international conflicts, acts of terrorism or sabotage, hostilities, revolutions, revolts, riots, civil unrest, lockouts, strikes or natural disasters); |
14. Umowa – umowa o świadczenie danej Usługi Elektronicznej, zawierana pomiędzy Sprzedawcą a Klientem na zasadach określonych w Regulaminie; |
14. Agreement – an agreement for the provision of a given Electronic Service, entered into between the Seller and the Customer under these Terms and Conditions; |
15. Umowa Sprzedaży – umowa sprzedaży Produktu w rozumieniu Kodeksu Cywilnego zawarta na odległość między Klientem a Sprzedawcą za pośrednictwem Sklepu, na zasadach określonych w Regulaminie; |
15. Sales Agreement – a contract for the sale of a Product within the meaning of the Civil Code, concluded at a distance between the Customer and the Seller through the Store under these Terms and Conditions; |
16. Usługa Elektroniczna – usługa świadczona drogą elektroniczną przez Sprzedawcę w rozumieniu art. 2 pkt 4 ustawy z dnia 18 lipca 2002 r. o świadczeniu usług drogą elektroniczną (t.j. Dz. U. z 2024 r. poz. 1513 ze zm.); |
16. Electronic Service – a service provided electronically by the Seller within the meaning of Article 2(4) of the Act of 18 July 2002 on the Provision of Electronic Services (consolidated text: Journal of Laws of 2024, item 1513, as amended); |
17. Przedsiębiorca – osoba fizyczna prowadząca działalność gospodarczą, osoba prawna lub jednostka organizacyjna nieposiadająca osobowości prawnej, której ustawa przyznaje zdolność prawną, prowadząca we własnym imieniu działalność gospodarczą lub zawodową; |
17. Business Customer – a natural person conducting business activity, a legal person or an organisational unit without legal personality which is granted legal capacity by law, conducting business or professional activity in its own name; |
18. Produkt – przedmiot Umowy Sprzedaży dostępny w ofercie Sklepu; |
18. Product – the subject matter of a Sales Agreement available in the Store's offer; |
19. Zamówienie – oświadczenie woli Klienta zmierzające do zawarcia Umowy Sprzedaży zawierające w szczególności rodzaj i liczbę Produktu i inne elementy wymagane przez powszechnie obowiązujące przepisy prawa. |
19. Order – the Customer's declaration of intent aimed at entering into a Sales Agreement, specifying in particular the type and quantity of the Product and other elements required by generally applicable law. |
| II. POSTANOWIENIA OGÓLNE | II. GENERAL PROVISIONS |
1. Regulamin określa zasady korzystania ze Sklepu, Usług Elektronicznych oraz zawierania i realizacji Umów Sprzedaży. Platforma sprzedażowa B2B dostępna pod adresem dambat.abstore.pl jest przeznaczona wyłącznie dla Przedsiębiorców posiadających numer NIP. Postanowienia Regulaminu dotyczące Konsumentów stosuje się do zakupów dokonywanych za pośrednictwem www.dambat.pl. |
1. These Terms and Conditions govern the use of the Store and Electronic Services and the conclusion and performance of Sales Agreements. The B2B sales platform available at dambat.abstore.pl is intended exclusively for Business Customers holding a Polish tax identification number (NIP). The provisions of these Terms and Conditions concerning Consumers apply to purchases made through www.dambat.pl. |
2. Akceptacja Regulaminu jest dobrowolna, ale konieczna w celu skorzystania z Usług Elektronicznych wymagających akceptacji Regulaminu oraz zawarcia Umowy Sprzedaży. |
2. Acceptance of the Terms and Conditions is voluntary, but is necessary in order to use Electronic Services which require such acceptance and to enter into a Sales Agreement. |
3. Informacje prezentowane w Sklepie stanowią wyłącznie zaproszenie do zawarcia umowy w rozumieniu art. 71 Kodeksu Cywilnego, a nie ofertę w rozumieniu Kodeksu Cywilnego. |
3. Information presented in the Store constitutes an invitation to enter into an agreement within the meaning of Article 71 of the Civil Code and not an offer within the meaning of the Civil Code. |

| IV. WYMAGANIA TECHNICZNE | IV. TECHNICAL REQUIREMENTS |
1. W celu skorzystania z Usług Elektronicznych oraz zawarcia Umowy Sprzedaży konieczne jest spełnienie przez Klienta następujących wymagań technicznych: |
1. In order to use the Electronic Services and enter into a Sales Agreement, the Customer must meet the following technical requirements: |
a. posiadanie urządzenia teleinformatycznego z dostępem do sieci Internet; |
a. have an ICT device with Internet access; |
b. korzystanie z przeglądarki internetowej co najmniej we wskazanych wersjach: |

c. włączenie obsługi JavaScript oraz plików cookies w zakresie niezbędnym do działania Sklepu; |
c. enable JavaScript and cookies to the extent necessary for the operation of the Store; |
d. posiadanie urządzenia umożliwiającego poprawne wypełnienie formularzy elektronicznych; |
d. have a device enabling electronic forms to be completed correctly; |
e. w przypadku Konta, Newslettera, dokonywania Zamówień oraz korzystania z formularzy wymagających kontaktu zwrotnego – posiadanie ważnego i aktywnego adresu e-mail lub innych wymaganych danych kontaktowych. |
e. for the Account, the Newsletter, placing Orders and forms requiring a response – have a valid and active e-mail address or other required contact details. |
| V. USŁUGI ELEKTRONICZNE | V. ELECTRONIC SERVICES |
1. Sprzedawca za pośrednictwem Sklepu świadczy, zależnie od funkcjonalności danej platformy, następujące Usługi Elektroniczne: |
1. Depending on the functionalities of the relevant platform, the Seller provides the following Electronic Services through the Store: |
a. przeglądanie, wyszukiwanie i pobieranie treści dostępnych w Sklepie, przy czym dostęp do asortymentu, cen i funkcjonalności platformy B2B wymaga zalogowania do Konta; |
a. browsing, searching and downloading content available in the Store, provided that access to the product range, prices and functionalities of the B2B platform requires the Customer to log in to the Account; |
b. korzystanie z Koszyka i formularza Zamówienia; |
b. using the Cart and the Order form; |
c. korzystanie z formularzy elektronicznych, w tym formularza zapytania o Produkt, przeliczników, formularza zgłoszeniowego, formularza kontaktowego; |
c. using electronic forms, including the Product enquiry form, conversion tools, submission form and contact form; |
d. założenie i korzystanie z Konta; |
d. creating and using an Account; |
e. porównywanie Produktów; |
e. comparing Products; |
f. newsletter; |
f. the Newsletter; |
g. czat. |
g. the chat service. |
2. Konto jest dostępne w ramach platformy B2B. W celu jego założenia Klient kontaktuje się ze Sprzedawcą telefonicznie, za pośrednictwem poczty elektronicznej lub opiekuna handlowego Sprzedawcy. Konto jest zakładane przez Sprzedawcę po pozytywnej weryfikacji danych Klienta, a dane dostępowe są przekazywane na wskazany adres e-mail. Umowa o świadczenie usługi Konta zostaje zawarta z chwilą pierwszego zalogowania po akceptacji Regulaminu. Klient może w dowolnym momencie zażądać usunięcia Konta, kontaktując się ze Sprzedawcą. |
2. The Account is available within the B2B platform. To have an Account created, the Customer contacts the Seller by telephone, e-mail or through the Seller's sales representative. The Account is created by the Seller after the Customer's details have been successfully verified, and the access credentials are sent to the e-mail address indicated by the Customer. The agreement for the Account service is concluded upon the first login after acceptance of these Terms and Conditions. The Customer may request deletion of the Account at any time by contacting the Seller. |
3. W celu skorzystania z formularzy elektronicznych konieczne jest przejście do dedykowanej zakładki (np. „Kontakt”, „Przeliczniki”), uzupełnienie wymaganych informacji oraz danych osobowych, a następnie kliknięcie przycisku wysyłki formularza. Do wysyłki formularzy może być konieczne również oznaczenie określonych checkboxów. Klient może w każdym momencie zrezygnować z formularzy poprzez odstąpienie od wysyłki formularza, zamknięcie strony internetowej lub przejście do innej zakładki. |
3. To use electronic forms, the Customer must access the relevant section (e.g. ‘Contact’ or ‘Conversion Tools’), provide the required information and personal data, and then click the button to submit the form. Submission of a form may also require the relevant checkboxes to be selected. The Customer may abandon the form at any time by not submitting it, closing the website or navigating to another section. |
4. W celu skorzystania z Koszyka należy dodać do niego Produkty. W zależności od dostępnych funkcjonalności Produkty mogą zostać zapisane po zamknięciu sesji, jednak nie gwarantuje to dostępności Produktu. Klient może w każdym momencie zaprzestać korzystania z Koszyka poprzez usunięcie z niego Produktów. |
4. In order to use the Cart, Products must be added to it. Depending on the available functionalities, Products may remain saved after the session has ended, but this does not guarantee Product availability. The Customer may stop using the Cart at any time by removing Products from it. |
5. Do korzystania z Newslettera konieczne jest podanie danych osobowych i wyrażenie zgody na otrzymywanie informacji handlowych drogą elektroniczną. Klient może w każdej chwili zrezygnować z Newslettera za pomocą linku rezygnacji zamieszczonego w każdej wiadomości lub kontaktując się ze Sprzedawcą. Newsletter przeznaczony jest wyłącznie dla Przedsiębiorców. |
5. To use the Newsletter, the Customer must provide personal data and consent to receiving commercial information electronically. The Customer may unsubscribe from the Newsletter at any time using the unsubscribe link included in each message or by contacting the Seller. The Newsletter is intended exclusively for Business Customers. |
6. W celu skorzystania z porównywania Produktów konieczne jest dodanie wybranych Produktów do odpowiedniej funkcji (porównanie Produktów). Klient może w dowolnym momencie zaprzestać korzystania z porównywania Produktów poprzez usunięcie Produktów z porównania. |
6. To compare Products, the Customer must add the selected Products to the relevant function (Product comparison). The Customer may stop using Product comparison at any time by removing the Products from the comparison. |
7. W celu skorzystania z czatu konieczne jest kliknięcie przycisku czatu znajdującego się w dolnym prawym rogu Sklepu, podanie niezbędnych danych osobowych oraz kliknięcie przycisku wysyłki wiadomości. Klient może w dowolnym momencie zaprzestać korzystania z czatu poprzez zamknięcie okienka czatu. |
7. To use the chat service, the Customer must click the chat button located in the bottom-right corner of the Store, provide the required personal data and click the button to send the message. The Customer may stop using the chat service at any time by closing the chat window. |
8. Usługi Elektroniczne świadczone są nieodpłatnie. Klient może w dowolnym momencie zrezygnować z korzystania z Usług Elektronicznych. |
8. Electronic Services are provided free of charge. The Customer may discontinue the use of Electronic Services at any time. |
9. Umowy o świadczenie Usług Elektronicznych w zakresie przeglądania, wyszukiwania i pobierania treści, Koszyka, formularza Zamówienia, formularzy elektronicznych, porównywania Produktów oraz czatu są zawierane na czas korzystania z danej Usługi i rozwiązują się z chwilą zaprzestania korzystania z niej. Umowy w zakresie Konta i Newslettera są zawierane na czas nieoznaczony i Klient może je wypowiedzieć w każdym czasie ze skutkiem natychmiastowym przez usunięcie Konta, wypisanie się z Newslettera lub kontakt ze Sprzedawcą. |
9. Agreements for Electronic Services consisting of browsing, searching and downloading content, using the Cart, the Order form and electronic forms, comparing Products, and using the chat are concluded for the period during which the relevant Service is used and terminate when its use ceases. The Agreements concerning the Account and the Newsletter are concluded for an indefinite period and may be terminated by the Customer at any time with immediate effect by deleting the Account, unsubscribing from the Newsletter or contacting the Seller. |
10. Korzystanie z Usług Elektronicznych wiąże się z typowymi zagrożeniami sieciowymi, w szczególności z możliwością działania złośliwego oprogramowania, phishingu, przejęcia danych dostępowych lub nieuprawnionego dostępu do transmisji. Klient powinien używać aktualnego oprogramowania, zabezpieczeń urządzenia, bezpiecznego połączenia oraz unikalnego hasła i nie udostępniać danych logowania. |
10. Use of the Electronic Services involves typical online risks, in particular malware, phishing, credential theft or unauthorised access to transmissions. The Customer should use up-to-date software, device safeguards, a secure connection and a unique password and should not disclose login credentials. |
| VI. UMOWA SPRZEDAŻY | VI. SALES AGREEMENT |
1. Sprzedawca umożliwia Klientom składanie Zamówień za pośrednictwem Sklepu, przy czym na platformie B2B złożenie Zamówienia jest możliwe wyłącznie po zalogowaniu do Konta. Główne cechy Produktu prezentowane są każdorazowo przy konkretnym Produkcie. |
1. The Seller enables Customers to place Orders through the Store, provided that on the B2B platform an Order may be placed only after logging into an Account. The main characteristics of a Product are presented on the page of the relevant Product. |
2. Złożenie Zamówienia możliwe jest poprzez wypełnienie formularza elektronicznego dostępnego w Sklepie. Złożenie Zamówienia odbywa się w następujący sposób: |
2. An Order may be placed by completing the electronic form available in the Store. An Order is placed as follows: |
a. wybranie Produktów oraz dodanie ich do Koszyka; |
a. selecting Products and adding them to the Cart; |
b. wypełnienie formularza Zamówienia wymaganymi danymi niezbędnymi do zawarcia oraz realizacji Zamówienia, a także dokonanie wyboru metody dostawy oraz płatności; |
b. completing the Order form with the data required to conclude and perform the Order and selecting the delivery and payment method; |
c. akceptację Regulaminu oraz jego warunków; |
c. accepting these Terms and Conditions; |
d. przesłanie Zamówienia do Sprzedawcy za pośrednictwem przycisku oznaczonego słowami „zamówienie z obowiązkiem zapłaty” albo innym równoważnym, jednoznacznym sformułowaniem. |
d. sending the Order to the Seller by means of a button labelled ‘order with an obligation to pay’ or another equivalent and unambiguous phrase. |
3. Po otrzymaniu Zamówienia Sprzedawca przesyła na adres e-mail podany przez Klienta automatyczne potwierdzenie jego otrzymania. Potwierdzenie otrzymania Zamówienia nie oznacza jego przyjęcia do realizacji ani zawarcia Umowy Sprzedaży, chyba że wiadomość ta zawiera również wyraźne oświadczenie Sprzedawcy o przyjęciu Zamówienia. |
3. After receiving an Order, the Seller sends an automatic acknowledgement of receipt to the e-mail address provided by the Customer. The acknowledgement of receipt does not constitute acceptance of the Order for performance or conclusion of a Sales Agreement unless the message also contains the Seller's express declaration accepting the Order. |
4. Umowa Sprzedaży zostaje zawarta z chwilą otrzymania przez Klienta informacji o przyjęciu Zamówienia do realizacji. Sprzedawca przekazuje Klientowi potwierdzenie zawarcia Umowy Sprzedaży na Trwałym nośniku, w szczególności w wiadomości e-mail. |
4. The Sales Agreement is concluded when the Customer receives information that the Order has been accepted for performance. The Seller provides the Customer with confirmation of the conclusion of the Sales Agreement on a Durable medium, in particular by e-mail. |
5. Jeżeli przyjęcie Zamówienia nie jest możliwe, w szczególności z powodu niedostępności Produktu, braku możliwości realizacji wybranego sposobu dostawy albo nieprawidłowości uniemożliwiających wykonanie Zamówienia, Sprzedawca niezwłocznie poinformuje o tym Klienta. Jeżeli Klient dokonał już płatności, uiszczona kwota zostanie zwrócona niezwłocznie, nie później niż w terminie 14 dni, przy użyciu tego samego sposobu płatności, chyba że Klient wyraźnie zgodzi się na inny sposób zwrotu, który nie wiąże się dla niego z kosztami. |
5. If the Order cannot be accepted, in particular due to Product unavailability, the inability to use the selected delivery method or irregularities preventing performance, the Seller will promptly inform the Customer. If the Customer has already paid, the amount paid will be refunded promptly and no later than within 14 days, using the same payment method unless the Customer expressly agrees to another method which does not entail any costs. |
6. Ceny Produktów podawane są w złotych polskich i obejmują podatki, chyba że w Sklepie wyraźnie wskazano inaczej. Łączna wartość Zamówienia obejmuje ceny zamówionych Produktów wraz z podatkami, koszty dostawy oraz inne koszty wyraźnie zaakceptowane przez Klienta. Łączna wartość Zamówienia jest przedstawiana Klientowi przed jego złożeniem. |
6. Product prices are stated in Polish zloty and include taxes unless the Store expressly indicates otherwise. The total value of an Order includes the prices of the ordered Products including taxes, delivery costs and any other costs expressly accepted by the Customer. The total value is presented to the Customer before the Order is placed. |
7. W przypadku informowania o obniżeniu ceny Produktu Sprzedawca podaje również informację o najniższej cenie tego Produktu, która obowiązywała w okresie 30 dni przed wprowadzeniem obniżki, a jeżeli Produkt jest oferowany krócej niż 30 dni – o najniższej cenie obowiązującej od dnia rozpoczęcia oferowania Produktu do dnia wprowadzenia obniżki. |
7. When announcing a reduction in the price of a Product, the Seller also provides information on the lowest price applied to that Product during the 30 days preceding the reduction. If the Product has been offered for less than 30 days, the Seller provides the lowest price applied from the date on which the Product was first offered until the reduction was introduced. |
8. Promocje obowiązujące w Sklepie nie łączą się, chyba że warunki aktualnie obowiązujących promocji stanowią inaczej. |
8. Promotions in the Store may not be combined unless the terms of the relevant promotions provide otherwise. |
| VII. DOSTAWA PRODUKTU | VII. PRODUCT DELIVERY |
1. Dostawa Zamówienia realizowana jest na adres albo do punktu odbioru wskazanego przez Klienta podczas składania Zamówienia. Sprzedawca udostępnia Klientom różne sposoby dostawy Zamówienia. Dostępne sposoby dostawy są prezentowane w Sklepie oraz w momencie składania Zamówienia. Dostępne metody dostawy mogą się różnić w zależności od wybranego Produktu lub wybranej metody płatności. |
1. The Order is delivered to the address or collection point indicated by the Customer when placing the Order. The Seller makes various delivery methods available. The available delivery methods are presented in the Store and while the Order is being placed. They may differ depending on the selected Product or payment method. |
2. Dostawa Produktu do Klienta jest odpłatna, a wysokość końcowej opłaty jest zależna od wybranej metody dostawy oraz wybranych Produktów. Opłata za dostawę jest prezentowana podczas składania Zamówienia. |
2. Product delivery is subject to a charge and the final charge depends on the selected delivery method and Products. The delivery charge is displayed while the Order is being placed. |
3. Termin dostawy jest wskazywany na stronie Produktu, podczas składania Zamówienia lub w potwierdzeniu Zamówienia. Termin ten obejmuje czas przygotowania Zamówienia do wysyłki oraz czas jego przewozu. |
3. The delivery time is indicated on the Product page, while the Order is being placed or in the Order confirmation. It includes the time required to prepare the Order for dispatch and the carriage time. |
4. Bieg terminu realizacji Zamówienia rozpoczyna się: |

b. for cash on delivery or deferred payment – on the day on which the Sales Agreement is concluded; |
c. w przypadku Produktów wykonywanych na zamówienie – zgodnie z terminem wskazanym w opisie Produktu albo uzgodnionym z Klientem. |
c. for made-to-order Products – in accordance with the period stated in the Product description or agreed with the Customer. |
5. Jeżeli nie wskazano innego terminu, Sprzedawca wydaje Produkt Klientowi niezwłocznie, nie później niż w terminie 30 dni od dnia zawarcia Umowy Sprzedaży. |
5. Unless another period is specified, the Seller delivers the Product to the Customer without undue delay and no later than 30 days after the Sales Agreement is concluded. |
6. Jeżeli Zamówienie obejmuje Produkty o różnych terminach realizacji, terminem realizacji całego Zamówienia jest najdłuższy z podanych terminów. Dostawa częściowa nie powoduje naliczenia Klientowi dodatkowych kosztów bez jego uprzedniej, wyraźnej zgody. |
6. If an Order includes Products with different performance times, the performance time for the entire Order is the longest of the stated times. Partial delivery will not result in additional charges to the Customer without the Customer's prior express consent. |
7. W przypadku przewidywanego opóźnienia Sprzedawca niezwłocznie poinformuje o nim Klienta. |
7. If a delay is anticipated, the Seller will promptly inform the Customer. |
8. W przypadku dostawy Produktu Klientowi ryzyko jego przypadkowej utraty lub uszkodzenia przechodzi na Klienta z chwilą wydania Produktu Klientowi albo wskazanej przez niego osobie trzeciej, innej niż przewoźnik. Jeżeli Klient samodzielnie wybrał przewoźnika, którego Sprzedawca nie oferował, ryzyko przechodzi na Klienta z chwilą powierzenia Produktu temu przewoźnikowi. |
8. For delivery of a Product to a Customer, the risk of accidental loss of or damage to the Product passes to the Customer when the Product is handed over to the Customer or to a third party designated by the Customer other than the carrier. If the Customer independently selects a carrier not offered by the Seller, the risk passes when the Product is handed over to that carrier. |
9. Klient zobowiązany jest do sprawdzenia stanu przesyłki przy odbiorze oraz, w razie stwierdzenia uszkodzenia, sporządzenia protokołu szkody i poinformowania Sprzedawcy. |
9. The Customer is required to inspect the condition of the shipment upon receipt and, if damage is found, to draw up a damage report and notify the Seller. |
| VIII. PŁATNOŚĆ ZA PRODUKT | VIII. PAYMENT FOR THE PRODUCT |
1. Sprzedawca udostępnia Klientom różne sposoby płatności z tytułu Umowy Sprzedaży. Dostępne metody płatności są prezentowane w Sklepie oraz w momencie składania Zamówienia. Dostępne metody płatności mogą się różnić w zależności od wybranego sposobu dostawy lub Produktu. |
1. The Seller offers Customers various payment methods under the Sales Agreement. The available payment methods are presented in the Store and when the Order is placed. The available payment methods may vary depending on the selected delivery method or Product. |
2. Rozliczenia transakcji płatnościami elektronicznymi oraz kartą płatniczą przeprowadzane są zgodnie z wyborem Klienta za pośrednictwem upoważnionych zewnętrznych dostawców płatniczych. |
2. Electronic and card payment transactions are processed, as selected by the Customer, by authorised external payment service providers. |
3. W przypadku braku otrzymania płatności Sprzedawca jest upoważniony do skontaktowania się z Klientem w celu poinformowania o braku płatności oraz konieczności jej realizacji w wyznaczonym terminie. |
3. If payment is not received, the Seller is entitled to contact the Customer to provide notice of the missing payment and the need to make it within a specified period. |
4. W przypadku wyboru płatności przy odbiorze Klient zobowiązany jest do uiszczenia płatności przy odbiorze Zamówienia. Odmowa odbioru Zamówienia lub brak uiszczenia płatności przy odbiorze skutkuje rozwiązaniem Umowy Sprzedaży, z zastrzeżeniem, że nie dotyczy to Umów Sprzedaży, których przedmiotem świadczenia jest Produkt nieprefabrykowany, wyprodukowany według specyfikacji Klienta lub służący zaspokojeniu jego zindywidualizowanych potrzeb. |
4. If cash on delivery is selected, the Customer must make payment when the Order is received. Refusal to collect the Order or failure to make the payment results in termination of the Sales Agreement, except where the Sales Agreement concerns a non-prefabricated Product made to the Customer's specifications or intended to meet the Customer's individual needs. |
5. Klient będący Przedsiębiorcą otrzyma fakturę ustrukturyzowaną zgodnie z przepisami prawa podatkowego za pośrednictwem Krajowego Systemu e-Faktur. W przypadku braku możliwości wystawienia lub przesłania faktury za pośrednictwem Krajowego Systemu e-Faktur, w szczególności z powodu awarii systemu, faktura zostanie wystawiona oraz doręczona zgodnie z trybem awaryjnym przewidzianym w przepisach prawa. |
5. A Customer who is a Business Customer will receive a structured invoice in accordance with tax law through the National e-Invoicing System (KSeF). If it is not possible to issue or transmit an invoice through KSeF, in particular due to a system failure, the invoice will be issued and delivered in accordance with the emergency procedure provided for by law. |
6. W przypadku Klientów niebędących Przedsiębiorcami Klient wyraża zgodę na otrzymanie dokumentu zakupu w formie elektronicznej oraz na jego udostępnianie i doręczenie w formie elektronicznej. |
6. Customers who are not Business Customers consent to receiving the proof-of-purchase document electronically and to its being made available and delivered electronically. |
| IX. OBOWIĄZKI KLIENTA | IX. CUSTOMER OBLIGATIONS |
1. Klient zobowiązany jest do: |

a. provide only true, complete and necessary data; |
b. zachowania w poufności danych umożliwiających dostęp do Konta i nieudostępniania ich osobom nieupoważnionym; |
b. keep Account access details confidential and not disclose them to unauthorised persons; |
c. stosowania się do bezwzględnie obowiązujących przepisów prawa, a także postanowień Regulaminu oraz przyjętych w tym zakresie zwyczajów i zasad współżycia społecznego. |
c. comply with mandatory law, these Terms and Conditions and the accepted customs and principles of social coexistence applicable in this respect. |
2. W związku z korzystaniem z Usług Elektronicznych zakazane jest w szczególności: |

a. dostarczanie przez Klientów treści o charakterze bezprawnym, w tym naruszających lub mogących naruszać prawa osób trzecich; |
a. the provision by Customers of unlawful content, including content infringing or capable of infringing third-party rights; |
b. ingerowanie w strukturę, układ, funkcjonalność lub zawartość Sklepu lub Usług, w tym poprzez ich modyfikację, adaptację czy przekształcenie, z wyjątkiem przypadków przewidzianych przez bezwzględnie obowiązujące przepisy prawa; |
b. interference with the structure, layout, functionality or content of the Store or Services, including by modifying, adapting or transforming them, except in cases permitted by mandatory law; |
c. gromadzenie lub przechowywanie danych osobowych innych Klientów; |
c. collecting or storing the personal data of other Customers; |
d. podejmowanie jakichkolwiek czynności, których celem lub skutkiem jest utrudnienie lub uniemożliwienie innym Klientom korzystania z Usług; |
d. taking any action whose purpose or effect is to hinder or prevent other Customers from using the Services; |
e. korzystanie z Usług niezgodnie z ich przeznaczeniem. |
e. using the Services contrary to their intended purpose. |
| X. REKLAMACJE | X. COMPLAINTS |
1. Klientowi przysługuje możliwość złożenia reklamacji dotyczącej niewykonania lub nienależytego wykonania Usługi lub realizacji Umowy Sprzedaży przez Sprzedawcę. |
1. The Customer may submit a complaint concerning the Seller's failure to provide, or improper provision of, a Service or performance of a Sales Agreement. |
2. Reklamację można złożyć w postaci elektronicznej na adres biuro@dambat.pl albo pisemnie na adres: DAMBAT JASTRZĘBSKI S.K.A., Adamów 50, 05-825 Grodzisk Mazowiecki. Reklamacja powinna zawierać informacje takie jak dane identyfikacyjne Klienta, opis sytuacji będącej podstawą reklamacji oraz oczekiwany sposób jej rozwiązania. |
2. A complaint may be submitted electronically to biuro@dambat.pl or in writing to: DAMBAT JASTRZĘBSKI S.K.A., Adamów 50, 05-825 Grodzisk Mazowiecki. The complaint should include information such as the Customer's identification details, a description of the circumstances giving rise to the complaint and the expected manner of resolution. |
3. Sprzedawca udziela odpowiedzi na reklamację Konsumenta lub Przedsiębiorcy na prawach Konsumenta w terminie 14 dni od dnia jej otrzymania. Odpowiedź przekazywana jest na papierze lub innym Trwałym nośniku. |
3. The Seller responds to a complaint submitted by a Consumer or a Business Customer with consumer rights within 14 days of receiving it. The response is provided on paper or another Durable medium. |
4. Postanowienia niniejszego punktu stosuje się odpowiednio do reklamacji dotyczących Produktu, w tym jego niezgodności z Umową Sprzedaży. |
4. This section applies accordingly to complaints concerning a Product, including its non-conformity with the Sales Agreement. |
| XI. ZGODNOŚĆ PRODUKTU Z UMOWĄ SPRZEDAŻY I RĘKOJMIA | XI. CONFORMITY OF THE PRODUCT WITH THE SALES AGREEMENT AND STATUTORY WARRANTY |
1. Sprzedawca ponosi wobec Klienta będącego Konsumentem odpowiedzialność za zgodność Produktu z Umową Sprzedaży na zasadach wynikających z przepisów prawa. |
1. The Seller is liable to a Customer who is a Consumer for the Product's conformity with the Sales Agreement in accordance with applicable law. |
2. Jeżeli Produkt jest niezgodny z Umową Sprzedaży, Klient będący Konsumentem może żądać jego naprawy albo wymiany, a w przypadkach przewidzianych przepisami prawa – obniżenia ceny albo odstąpienia od Umowy Sprzedaży. Sprzedawca odpowiada za brak zgodności Produktu z umową istniejący w chwili jego dostarczenia i ujawniony, co do zasady, w ciągu dwóch lat od tej chwili. |
2. If the Product does not conform to the Sales Agreement, a Customer who is a Consumer may demand its repair or replacement and, in the cases provided for by law, a price reduction or withdrawal from the Sales Agreement. The Seller is liable for a lack of conformity existing at the time the Product is delivered and disclosed, as a rule, within two years of that time. |

Jeżeli jest to niezbędne dla prawidłowej oceny wad fizycznych Produktu, po ustaleniach wstępnych ze Sprzedawcą, Produkt należy dostarczyć na adres wskazany przez Sprzedawcę. |
4. A lack of conformity of the Product with the Sales Agreement must be reported to the Seller under the complaint procedure referred to in section X. If necessary for a proper assessment of the Product's physical defects, following preliminary arrangements with the Seller, the Product must be delivered to the address indicated by the Seller. |
5. Produkty dostępne w Sklepie mogą być objęte gwarancją producenta. Informacja o objęciu Produktu gwarancją oraz właściwa dla niego karta gwarancyjna, określająca szczegółowe warunki i sposób realizacji gwarancji, są udostępniane przy prezentacji Produktu. |
5. Products available in the Store may be covered by a manufacturer's guarantee. Information on whether the Product is covered by a guarantee and the applicable guarantee card, setting out the detailed terms and the procedure for exercising rights under the guarantee, are made available alongside the Product listing. |
| XII. PRAWO DO ODSTĄPIENIA OD UMOWY ORAZ UMOWY SPRZEDAŻY | XII. RIGHT OF WITHDRAWAL FROM THE AGREEMENT AND THE SALES AGREEMENT |
1. Konsument może odstąpić od Umowy lub Umowy Sprzedaży zawartej na odległość bez podania przyczyny i bez ponoszenia kosztów innych niż przewidziane przez przepisy prawa w terminie 14 dni, z zastrzeżeniem wyjątków wskazanych poniżej. Do zachowania terminu wystarczy wysłanie Sprzedawcy przed jego upływem jednoznacznego oświadczenia o odstąpieniu od Umowy. |

A Consumer may withdraw from an Agreement or Sales Agreement concluded at a distance without giving any reason and without incurring costs other than those provided for by law within 14 days, subject to the exceptions set out below. It is sufficient for the Consumer to send an unequivocal statement of withdrawal to the Seller before the period expires. |

3. Konsument może skorzystać z wzoru formularza odstąpienia, stanowiącego Załącznik nr 1 do Regulaminu, jednak nie jest to obowiązkowe. |

Bieg terminu na odstąpienie od Umowy Sprzedaży rozpoczyna się od dnia objęcia Produktu w posiadanie przez Konsumenta lub wskazaną przez niego osobę trzecią inną niż przewoźnik, a w przypadku Umowy Sprzedaży obejmującej kilka Produktów dostarczanych osobno, partiami lub w częściach – od objęcia w posiadanie ostatniego Produktu, partii lub części. W przypadku innych Umów bieg terminu rozpoczyna się od dnia zawarcia Umowy. |
4. The period for withdrawal from a Sales Agreement begins on the day on which the Consumer or a third party designated by the Consumer other than the carrier takes physical possession of the Product. For a Sales Agreement covering several Products delivered separately, in lots or in parts, the period begins when the last Product, lot or part is taken into possession. For other Agreements, the period begins on the day on which the Agreement is concluded. |
5. Konsument ma obowiązek niezwłocznie, nie później niż w terminie 14 dni od dnia, w którym odstąpił od Umowy Sprzedaży, zwrócić Produkt na adres: DAMBAT JASTRZĘBSKI S.K.A., Adamów 50, 05-825 Grodzisk Mazowiecki. Do zachowania terminu wystarczy odesłanie Produktu przed jego upływem. Konsument ponosi bezpośrednie koszty zwrotu Produktu, chyba że Sprzedawca zgodził się je ponieść. |
5. The Consumer must return the Product without undue delay and no later than 14 days after withdrawing from the Sales Agreement to: DAMBAT JASTRZĘBSKI S.K.A., Adamów 50, 05-825 Grodzisk Mazowiecki. The deadline is met if the Product is dispatched before it expires. The Consumer bears the direct cost of returning the Product unless the Seller has agreed to bear it. |

Sprzedawca niezwłocznie, nie później niż w terminie 14 dni od dnia otrzymania oświadczenia o odstąpieniu od Umowy lub Umowy Sprzedaży, zwraca Klientowi wszystkie dokonane płatności, w tym koszty dostarczenia Produktu. Jeżeli Sprzedawca nie zaproponował, że sam odbierze Produkt, może wstrzymać się ze zwrotem płatności do chwili otrzymania Produktu lub dostarczenia przez Klienta dowodu jego odesłania, w zależności od tego, które zdarzenie nastąpi wcześniej. Jeżeli Klient dokonał wyboru sposobu dostawy innego niż najtańszy zwykły sposób dostawy dostępny w Sklepie, Sprzedawca nie jest zobowiązany do zwrotu Klientowi poniesionych przez niego dodatkowych kosztów w wysokości przekraczającej koszt najtańszego zwykłego sposobu dostawy. Zwrot płatności następuje w sposób, w jaki dokonano płatności za Zamówienie, chyba że Klient wyraźnie zgodzi się na inny sposób zwrotu, który nie będzie się dla niego wiązał z dodatkowymi kosztami. |
6. The Seller refunds all payments made by the Customer, including Product delivery costs, without undue delay and no later than 14 days after receiving the statement of withdrawal from the Agreement or Sales Agreement. If the Seller has not offered to collect the Product, the Seller may withhold reimbursement until the Product is received or the Customer provides evidence of having sent it back, whichever occurs first. If the Customer selected a delivery method other than the least expensive standard delivery method available in the Store, the Seller is not required to reimburse the additional costs exceeding the cost of the least expensive standard delivery method. The refund is made using the payment method used for the Order unless the Customer expressly agrees to another method that does not involve additional costs. |
7. Klient ponosi odpowiedzialność za zmniejszenie wartości Produktu będące wynikiem korzystania z niego w sposób wykraczający poza konieczny do stwierdzenia charakteru, cech oraz funkcjonowania Produktu. |
7. The Consumer is liable for any diminished value of the Product resulting from handling it beyond what is necessary to establish the nature, characteristics and functioning of the Product. |
8. Prawo do odstąpienia nie przysługuje w przypadkach przewidzianych przez przepisy prawa, w szczególności w odniesieniu do umów: |
8. The right of withdrawal does not apply in the cases provided for by law, in particular to agreements: |
a. w których przedmiotem świadczenia jest Produkt nieprefabrykowany, wyprodukowany według specyfikacji Klienta lub służący zaspokojeniu jego zindywidualizowanych potrzeb; |
a. for the supply of a non-prefabricated Product made to the Consumer's specifications or intended to meet the Consumer's individual needs; |
b. w których przedmiotem świadczenia są Produkty, które po dostarczeniu, ze względu na swój charakter, zostają nierozłącznie połączone z innymi rzeczami; |
b. for the supply of Products which, after delivery, according to their nature, are inseparably mixed with other items; |
c. w których Konsument wyraźnie żądał, aby Sprzedawca do niego przyjechał w celu dokonania pilnej naprawy lub konserwacji. Jeżeli Sprzedawca świadczy dodatkowo inne usługi albo dostarcza Produkty inne niż części zamienne niezbędne do wykonania naprawy lub konserwacji, prawo odstąpienia przysługuje w odniesieniu do tych dodatkowych usług lub Produktów. |
c. under which the Consumer expressly requested the Seller to visit the Consumer for urgent repair or maintenance. If the Seller also provides other services or supplies Products other than replacement parts necessary to carry out the repair or maintenance, the right of withdrawal applies to those additional services or Products. |

| XIV. ODPOWIEDZIALNOŚĆ SPRZEDAWCY | XIV. SELLER'S LIABILITY |
1. Sprzedawca ponosi odpowiedzialność za szkody wynikające z niewykonania lub nienależytego wykonania Umowy lub Umowy Sprzedaży, chyba że niewykonanie lub nienależyte wykonanie Umowy lub Umowy Sprzedaży jest następstwem okoliczności, za które Sprzedawca nie ponosi odpowiedzialności, z zastrzeżeniem ppkt 2 i 3 poniżej. |
1. The Seller is liable for loss resulting from the non-performance or improper performance of an Agreement or Sales Agreement unless such non-performance or improper performance is due to circumstances for which the Seller is not liable, subject to subparagraphs 2 and 3 below. |
2. Sprzedawca nie ponosi odpowiedzialności za poniższe zdarzenia i ich skutki wyłącznie w zakresie, w jakim wynikają one z okoliczności, za które zgodnie z prawem nie odpowiada: |
2. The Seller is not liable for the following events and their consequences solely to the extent that they result from circumstances for which the Seller is not legally responsible: |
a. zakłócenia w funkcjonowaniu Usługi wynikające z przyczyn od niego niezależnych, w szczególności spowodowane działaniem Siły Wyższej lub niedozwolonej ingerencji osób trzecich lub zaistniałe w związku z awarią systemu łączności telekomunikacyjnej oraz inne skutki wadliwego działania łączy telekomunikacyjnych i szkody przez nie wywołane; |
a. disruption to a Service arising from causes beyond the Seller's control, in particular Force Majeure, unauthorised interference by third parties or a failure of the telecommunications system, and other consequences of defective telecommunications links or damage caused by them; |
b. szkody powstałe w wyniku uszkodzenia sprzętu komputerowego Klienta bądź jego zasobów danych, w trakcie lub w związku z korzystaniem z Usług, w szczególności na skutek przedostania się do systemu informatycznego Klienta wirusów komputerowych. |
b. damage arising from damage to the Customer's computer equipment or data resources during or in connection with the use of the Services, in particular as a result of computer viruses entering the Customer's IT system. |
3. Żadne postanowienie Regulaminu nie wyłącza ani nie ogranicza praw Konsumenta lub Przedsiębiorcy na prawach Konsumenta ani odpowiedzialności Sprzedawcy, których zgodnie z prawem nie można wyłączyć lub ograniczyć, w szczególności odpowiedzialności za szkodę wyrządzoną umyślnie, szkody na osobie, niezgodność Produktu z Umową Sprzedaży oraz odpowiedzialności za produkt. |
3. Nothing in these Terms and Conditions excludes or limits the rights of a Consumer or a Business Customer with consumer rights or any liability of the Seller which may not be excluded or limited by law, in particular liability for wilful misconduct, personal injury, non-conformity of the Product with the Sales Agreement and product liability. |
4. Klient odpowiada za szkodę powstałą w wyniku ujawnienia podmiotom nieuprawnionym indywidualnego loginu oraz hasła. |
4. The Customer is liable for damage caused by disclosing the individual login and password to unauthorised persons. |
| XV. ZMIANA REGULAMINU | XV. AMENDMENTS TO THE TERMS AND CONDITIONS |
1. Sprzedawca jest uprawniony do dokonania zmiany Regulaminu wyłącznie w przypadku zaistnienia co najmniej jednej z poniżej wskazanych istotnych przyczyn (katalog zamknięty): |
1. The Seller may amend these Terms and Conditions only if at least one of the following material grounds occurs (exhaustive list): |
a. zmiany sposobu świadczenia Usług spowodowanej względami technicznymi lub technologicznymi; |
a. a change to the method of providing the Services for technical or technological reasons; |
b. zmiany powszechnie obowiązujących przepisów prawa, w szczególności w zakresie usług świadczonych drogą elektroniczną, wpływających na wzajemne prawa i obowiązki określone w Regulaminie, lub zmiany interpretacji powszechnie obowiązujących przepisów prawa wynikającej z orzecznictwa sądów, decyzji, zaleceń lub rekomendacji uprawnionych organów; |
b. a change to generally applicable law, in particular in the field of electronic services, affecting the parties' rights and obligations under these Terms and Conditions, or a change in the interpretation of generally applicable law resulting from court judgments or decisions, guidance or recommendations of competent authorities; |
c. zmiany zakresu lub sposobu świadczenia Usług poprzez wprowadzenie nowych funkcjonalności lub usług, modyfikację lub wycofanie dotychczasowych Usług; |
c. a change to the scope or method of providing the Services by introducing new functionalities or services or modifying or withdrawing existing Services; |
d. konieczności doprecyzowania postanowień Regulaminu w celu zapewnienia jego jednoznaczności, przejrzystości lub zgodności z dobrymi praktykami rynkowymi; |
d. the need to clarify provisions of these Terms and Conditions to ensure that they are unambiguous, transparent or compliant with good market practice; |
e. wystąpienia okoliczności niezależnych od Sprzedawcy, mających wpływ na możliwość świadczenia Usług zgodnie z dotychczasowymi warunkami, w szczególności związanych z Siłą Wyższą lub zmianami regulacyjnymi. |
e. circumstances beyond the Seller's control affecting the ability to provide the Services on the existing terms, in particular Force Majeure or regulatory changes. |
2. Zmiana Regulaminu zostanie wprowadzona poprzez zamieszczenie nowej treści Regulaminu na stronie internetowej, a w zakresie, w jakim Sprzedawca dysponuje adresem poczty elektronicznej Klienta – Regulamin zostanie przesłany w formie wiadomości e-mail. |
2. An amendment will be made by posting the new Terms and Conditions on the website and, where the Seller holds the Customer's e-mail address, by sending them to the Customer by e-mail. |
3. Zmiany wchodzą w życie po upływie 14 dni od dnia powiadomienia Klienta, zgodnie z ppkt 2 powyżej. |
3. Amendments enter into force 14 days after the Customer is notified in accordance with subparagraph 2 above. |
4. W przypadku złożenia przez Klienta oświadczenia o braku zgody na wprowadzone zmiany w Regulaminie Umowa rozwiązuje się wraz z upływem terminu wejścia w życie nowego Regulaminu. Zmiana Regulaminu pozostaje bez wpływu na Umowy Sprzedaży zawarte przez Sprzedawcę i Klienta przed zmianą Regulaminu. |
4. If the Customer states that the Customer does not accept an amendment to the Terms and Conditions, the Agreement terminates when the new Terms and Conditions enter into force. An amendment does not affect Sales Agreements concluded between the Seller and the Customer before the amendment. |
| XVI. ROZWIĄZANIE UMOWY | XVI. TERMINATION OF THE AGREEMENT |
1. Umowa pomiędzy Klientem a Sprzedawcą w zakresie świadczenia Usług Elektronicznych wygasa wskutek: |
1. The Agreement between the Customer and the Seller for the provision of Electronic Services terminates as a result of: |
a. skorzystania przez Klienta z prawa do odstąpienia od Umowy; |
a. the Customer exercising the right to withdraw from the Agreement; |
b. złożenia przez Klienta oświadczenia o wypowiedzeniu Umowy ze skutkiem natychmiastowym; |
b. the Customer giving notice to terminate the Agreement with immediate effect; |
c. złożenia przez Sprzedawcę oświadczenia o wypowiedzeniu Umowy z 30-dniowym okresem wypowiedzenia z ważnych przyczyn wskazanych w Regulaminie; |
c. the Seller giving 30 days' notice to terminate the Agreement for a valid reason specified in these Terms and Conditions; |
d. braku akceptacji zmian Regulaminu zgodnie z pkt XV ppkt 4 Regulaminu; |
d. failure to accept amendments to these Terms and Conditions in accordance with section XV(4); |
e. rozwiązania przez Sprzedawcę Umowy na zasadach wskazanych w ppkt 2 poniżej. |
e. termination of the Agreement by the Seller under subparagraph 2 below. |
2. Umowa w zakresie świadczenia Usług Elektronicznych z Klientem może być rozwiązana przez Sprzedawcę ze skutkiem natychmiastowym w przypadku stwierdzenia przez Sprzedawcę: |
2. The Seller may terminate an Agreement for the provision of Electronic Services with immediate effect if the Seller finds: |
a. podjęcia lub próby podjęcia przez Klienta działań sprzecznych z bezwzględnie obowiązującymi przepisami prawa, dobrymi obyczajami lub zasadami współżycia społecznego; |
a. that the Customer has taken or attempted to take actions contrary to mandatory law, good practice or the principles of social coexistence; |
b. naruszenia obowiązków Klienta, o których mowa w pkt IX ppkt 1 Regulaminu; |
b. a breach of the Customer's obligations referred to in section IX(1); |
c. naruszenia zakazów, o których mowa w pkt IX ppkt 2 Regulaminu, w szczególności zakazu dostarczania treści bezprawnych lub podejmowania przez Klienta działań mających na celu lub skutkujących zakłóceniem pracy systemu informatycznego, na którym oparte są Usługi, lub mogących powodować utrudnienia w korzystaniu z Usługi przez Sprzedawcę lub innych Klientów; |
c. a breach of the prohibitions referred to in section IX(2), in particular the prohibition on providing unlawful content or on the Customer taking actions intended or liable to disrupt the IT system on which the Services are based or to hinder the use of a Service by the Seller or other Customers; |
d. podjęcia lub próby podjęcia przez Klienta innych działań mogących skutkować powstaniem szkody dla innych Klientów lub Sprzedawcy. |
d. that the Customer has taken or attempted to take other actions capable of causing damage to other Customers or the Seller. |
| XVII. LICENCJA | XVII. LICENCE |
1. Materiały prezentowane w Sklepie, w szczególności teksty, fotografie, grafiki, elementy identyfikacji wizualnej, oznaczenia, logotypy, układ stron, oprogramowanie oraz zbiory i bazy danych, objęte są prawami przysługującymi Sprzedawcy lub osobom trzecim, od których Sprzedawca uzyskał odpowiednie uprawnienia. |
1. Materials presented in the Store, in particular texts, photographs, graphics, visual identity elements, signs, logos, page layouts, software, collections and databases, are protected by rights vested in the Seller or third parties from whom the Seller has obtained appropriate rights. |
2. Klient może korzystać z materiałów nieodpłatnie wyłącznie w zakresie niezbędnym do skorzystania ze Sklepu, w szczególności przeglądania ich treści, składania Zamówień oraz wykonywania umów zawartych ze Sprzedawcą. |
2. The Customer may use the materials free of charge only to the extent necessary to use the Store, in particular to browse its content, place Orders and perform agreements concluded with the Seller. |
3. Klient, zamieszczając w ramach Sklepu treści, udziela Sprzedawcy niewyłącznej, nieodpłatnej licencji, bez ograniczeń terytorialnych, na utrwalanie, zwielokrotnianie, publiczne udostępnianie i techniczne dostosowywanie tych treści wyłącznie w zakresie niezbędnym do ich publikacji, moderacji, zapewnienia funkcjonowania Sklepu oraz wykonania Umowy. Licencja jest udzielana na czas publikacji treści w Sklepie oraz przez okres niezbędny do ustalenia, dochodzenia lub obrony roszczeń. Sprzedawca może korzystać z podmiotów trzecich i udzielać sublicencji wyłącznie w tym zakresie. Klient oświadcza, że posiada prawa niezbędne do udzielenia licencji. |
3. By posting content in the Store, the Customer grants the Seller a non-exclusive, royalty-free, territorially unrestricted licence to record, reproduce, make publicly available and technically adapt that content solely to the extent necessary for its publication and moderation, the operation of the Store and performance of the Agreement. The licence is granted for the period during which the content is published in the Store and for the period necessary to establish, pursue or defend claims. The Seller may use third parties and grant sublicences only to that extent. The Customer represents that the Customer holds the rights necessary to grant the licence. |
| XVIII. POSTANOWIENIA DOTYCZĄCE PRZEDSIĘBIORCÓW | XVIII. PROVISIONS APPLICABLE TO BUSINESS CUSTOMERS |
1. Postanowienia pkt XVIII Regulaminu odnoszą się wyłącznie do Przedsiębiorców oraz mają pierwszeństwo względem pozostałych postanowień Regulaminu. |
1. The provisions of section XVIII apply exclusively to Business Customers and prevail over the remaining provisions of these Terms and Conditions. |
2. Odpowiedzialność Sprzedawcy z tytułu rękojmi za Produkt wobec Przedsiębiorcy zostaje wyłączona na podstawie art. 558 § 1 Kodeksu Cywilnego. Sprzedawca nie ponosi odpowiedzialności wobec Przedsiębiorców za niezgodność towaru z Umową, o której mowa w pkt XI Regulaminu. |
2. The Seller's liability under the statutory warranty for defects in a Product towards a Business Customer is excluded pursuant to Article 558 § 1 of the Civil Code. The Seller is not liable to Business Customers for lack of conformity of goods with the Agreement referred to in section XI. |
3. Odpowiedzialność Sprzedawcy ograniczona jest do rzeczywistej straty pozostającej w normalnym związku przyczynowym z niewykonaniem lub nienależytym wykonaniem Umowy lub Umowy Sprzedaży. Sprzedawca nie ponosi odpowiedzialności za utracone korzyści, szkody pośrednie lub następcze. Na tych samych zasadach Sprzedawca ponosi odpowiedzialność za działania lub zaniechania osób, przy pomocy których wykonuje Umowę lub którym jej wykonanie powierza. |
3. The Seller's liability is limited to actual loss remaining in a normal causal relationship with the non-performance or improper performance of an Agreement or Sales Agreement. The Seller is not liable for lost profits or indirect or consequential loss. The Seller is liable on the same terms for acts or omissions of persons whose assistance the Seller uses to perform an Agreement or to whom the Seller entrusts its performance. |
4. W każdym przypadku ponoszenia przez Sprzedawcę odpowiedzialności wobec Przedsiębiorców, bez względu na podstawę prawną roszczenia, jest ona ograniczona do wartości zapłaty uiszczonej na podstawie Umowy lub Umowy Sprzedaży, w związku z której wykonaniem powstała szkoda. |
4. Whenever the Seller is liable to a Business Customer, irrespective of the legal basis of the claim, such liability is limited to the amount paid under the Agreement or the Sales Agreement in connection with the performance of which the loss arose. |
5. Sprzedawca może zmienić postanowienia Regulaminu odnoszące się do Przedsiębiorców w dowolnym momencie, bez podania przyczyny. |
5. The Seller may amend the provisions of these Terms and Conditions applicable to Business Customers at any time without stating a reason. |
6. Sprzedawca jest uprawniony do wypowiedzenia Umowy lub Umowy Sprzedaży zawartej z Przedsiębiorcą ze skutkiem natychmiastowym, bez obowiązku wskazywania przyczyny, poprzez złożenie Przedsiębiorcy oświadczenia o wypowiedzeniu w dowolnej formie. |
6. The Seller is entitled to terminate an Agreement or Sales Agreement entered into with a Business Customer with immediate effect, without being required to state a reason, by submitting a notice of termination to the Business Customer in any form. |
7. Wszelkie spory pomiędzy Sprzedawcą a Przedsiębiorcą zostają poddane sądowi właściwemu ze względu na siedzibę Sprzedawcy. |
7. Any disputes between the Seller and a Business Customer shall be submitted to the court having jurisdiction over the Seller's registered office. |
8. Postanowień pkt XVIII Regulaminu nie stosuje się do Przedsiębiorców na prawach Konsumenta. |
8. The provisions of section XVIII do not apply to Business Customers with consumer rights. |
| XIX. POSTANOWIENIA KOŃCOWE | XIX. FINAL PROVISIONS |
1. Prawem właściwym dla zawarcia Umowy lub Umowy Sprzedaży jest prawo Rzeczypospolitej Polskiej, a sądami – sądy powszechne w Rzeczypospolitej Polskiej, chyba że co innego wynika z bezwzględnie obowiązujących przepisów prawa. |
1. The law applicable to the conclusion of an Agreement or Sales Agreement is the law of the Republic of Poland and the courts of general jurisdiction in the Republic of Poland shall have jurisdiction, unless mandatory law provides otherwise. |
2. Postanowienia Regulaminu nie mają na celu wyłączać lub ograniczać jakichkolwiek praw Konsumentów przysługujących im na mocy bezwzględnie obowiązujących przepisów prawa. Wszelkie ewentualne wątpliwości w tym zakresie Sprzedawca tłumaczy na korzyść Klientów będących Konsumentami. |
2. The provisions of these Terms and Conditions are not intended to exclude or limit any rights granted to Consumers under mandatory provisions of law. Any doubts in this respect shall be interpreted by the Seller in favour of Customers who are Consumers. |
3. W zakresie nieuregulowanym w Regulaminie zastosowanie znajdują bezwzględnie obowiązujące przepisy prawa polskiego. |
3. Any matters not governed by these Terms and Conditions are subject to mandatory provisions of Polish law. |
4. Jeżeli jakiekolwiek istniejące lub przyszłe postanowienie lub część postanowienia Regulaminu zostanie uznane za nieważne, nieskuteczne lub niewykonalne w całości lub części z dowolnego powodu obecnie lub w przyszłości, jego nieważność, nieskuteczność lub niewykonalność nie ma wpływu na wykonalność pozostałych postanowień Regulaminu. Regulamin będzie interpretowany zgodnie z przepisami prawa tak, jakby niewykonalne postanowienie nigdy nie było w nim zawarte, a Sprzedawca i Klient w dobrej wierze rozpoczną negocjacje mające na celu przeformułowanie takiego postanowienia, aby było ono wykonalne i skuteczne i aby odzwierciedlało intencje Sprzedawcy i Klienta w chwili akceptacji Regulaminu przez Klienta. |
4. If any existing or future provision, or part of a provision, of these Terms and Conditions is held invalid, ineffective or unenforceable in whole or in part for any reason, this shall not affect the enforceability of the remaining provisions. These Terms and Conditions shall be interpreted in accordance with the law as if the unenforceable provision had never been included, and the Seller and the Customer shall in good faith commence negotiations to reformulate that provision so that it is enforceable and effective and reflects the parties' intentions at the time the Terms and Conditions were accepted. |
5. Wiążącą wersją Regulaminu jest wersja polska. W celu uniknięcia wątpliwości, wszelkie inne wersje językowe są publikowane przez Sprzedawcę wyłącznie dla wygody Klienta i nie mają charakteru wiążącego. |
5. The Polish version of these Terms and Conditions is binding. Any other language versions are published by the Seller solely for the Customer's convenience and are not binding. |
6. Konsument ma możliwość skorzystania z pozasądowych sposobów rozpatrywania reklamacji i dochodzenia roszczeń. Skorzystanie z pozasądowych sposobów rozpatrywania reklamacji i dochodzenia roszczeń ma charakter dobrowolny. Szczegółowe informacje dotyczące sposobów rozpatrywania reklamacji lub dochodzenia roszczeń dostępne są pod następującymi adresami: |
6. A Consumer may use out-of-court complaint and redress mechanisms. The use of out-of-court complaint handling and redress mechanisms is voluntary. Detailed information on complaint handling or redress mechanisms is available at: |

7. Sprzedawca składa oświadczenie o zgodzie albo odmowie udziału w postępowaniu w sprawie pozasądowego rozwiązywania sporów konsumenckich na papierze lub innym Trwałym nośniku, jeżeli po złożeniu przez Konsumenta reklamacji spór nie został rozwiązany. |
7. If a dispute has not been resolved following a Consumer's complaint, the Seller provides a statement on paper or another Durable medium indicating whether the Seller agrees or refuses to participate in out-of-court consumer dispute resolution proceedings. |
8. Regulamin wchodzi w życie w dniu 01.11.2026 r. |
